TERMS & CONDITIONS

By placing a custom order you state that you are agreeing to the terms and conditions presented below.

 

Offers and Price quotations:

 

  • Offers and quotations are without engagement. This means you do not automatically place an order by requesting a quote via the Custom Order Form. 
     

  • When you are ready to place your Custom Order you are required to reply to my email message and confirm or the Custom Order in order to secure the spot for your order to be made.
     

  • The Price quote provided is valid for 1 month since submission unless we agree otherwise.


Price and payment methods:

 

  • All prices stated on the website are in Euros (please use a provided currency converter) and include the tax (VAT).
     

  • Prices are not negotiable. The prices on the website are just an indication. Contact me for an exact price quote.
     

  • I retain the right to change the prices on my website at any time, without the need for prior notice.
     

  • Payment must be made beforehand, in full and have cleared before the item is shipped.
     

  •  I will create a custom listing in my shop for you to purchase. Payment plans via PayPal are available if needed (you can message me to discuss this further).
     

  • If a Payment plan is made to split the payment, I will start working on the plushie when at least half of the payment was done.
     

Shipping:
 

  • All orders are shipped with a Track & Trace option via Post NL. 
     

  • Buyers are responsible for any customs and import taxes that may apply.
     

  • Item will be shipped after the completion and clearance of the payment. Shipping times depend on country and customs. See shipping indication times in the Pricing guide.
     

  • I am not responsible for damaged or lost mail but write me and we will figure a way to fix things. If an item arrives damaged (provide evidence with a photo and the written note by the forwarder/delivery person), I will replace it but the buyer will have to pay shipping fees.
     

  • If an addressee does not accept/pick up a package and the order is shipped back to me, a buyer covers repeat shipping costs.
     

Returns and Cancellations:

 

  • I'm sorry but at this time I cannot accept refunds or exchanges for custom made items, so please read the descriptions carefully before buying.
     

  • If you have purchased an already made items from me or my webshops, send me a message and you can return the item within 14 days of purchase under the condition that the item is unused and undamaged. After the item is returned a refund will be issued.
     

  • Buyers are responsible for return postage costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.
     

  • If you wish to cancel your order a full refund will be issued if the plush is not yet in the making. If the materials have been purchased or the item is already in production the cost of it will be deducted from the refund.
     

  • If the custom item was finished and you wish to cancel, no refunds will be issued.
     

  • The following items can't be returned or exchanged - Because of the nature of these items, unless they arrive damaged or defective, I can't accept returns for:

    - Custom or personalized orders
    - Digital downloads
    - Items on sale
     

Cleaning and Safety:

  • Plushies are not meant to be a kid's toy because of the handmade nature and small parts. It is meant as an art/collector's companion for grown-ups. Plushies are handmade and not designed for rough play or kids younger than 15 years.
     

  • f giving them to a young child, do not leave unsupervised. If you want me to create a Plush toy specifically for a young child let me know in your order that way we can discuss the materials to be used for the order.
     

  • Plushies are not to be washed in a washing machine or put in a dryer! If dirty spot-clean with a damp cloth or some soap detergent and let it air dry. You can read more about it here.

 

Ownership and Copyright:
 

  • Me - Nina Curk (Dragons' Garden) retain all the intellectual propriety rights (Copyright, Patent rights, Trademark rights, etc.) for my Original Characters.
     

  • I claim the right to my original characters and character interpretations and do not want to see them reproduced elsewhere. All my creations are protected by copyright law.
     

  • I do NOT claim the rights to characters that are based on video games, movies, anime. Credit to the original artist will be given for Fanart Characters.
     

  • I will not make an original character that doesn't belong to the commissioner unless the owner of the original character sends me their written consent.
     

Other:

 

  • Plushies come from a pet and smoke-free home.
     

  • There is a line of scented plushies, but they are specifically labeled as such, if you have any allergies to certain scents, there is also an option to choose the scent.
     

  • I post Work in Progress photos on my social media. If your order is a gift or a ''top secret'' project please inform me upfront not to post anything online.
     

  • The items are all handmade, so slight variations can occur. Characters and my interpretations of them are heavily influenced by my own style.
     

  • The colors of the items on the photo and in real life may slightly vary due to the colors or brightness of your screen.
     

  • I will not create any mature content: nothing sexual, nothing violent or offensive.
     

  • I do not accept orders for any human or machine type of character. I specialize in creatures only.
     

  • I retain the right to refuse your order at any time. This applies to special cases; for example, if the customer is rude and offensive or in case my schedule would not allow me to meet the agreed deadline.
